The Patent Acts 1999 gives effect to the Patent Cooperation Treaty. As a result, patent applications can no longer be filed under the Registration of Patents and Registration of UK Patents Acts.

Procedures And Documents For Filing Of Patents In Dominica

  1. The Requirements
      The patent application must include:

    • Petition
    • Abstract
    • Description
    • Drawings
    • Claims
    • Authorization of Agent
  2. Nature of DocumentsAll applications, notices, statements, papers having representations affixed, or other documents authorized or required by the Act or the Regulations to be made, left with or sent to the Registrar must be on strong, durable white paper and, except in the case of statutory documents and affidavits, must be written on one side of the paper only.Each sheet of paper other than drawings shall have its short sides at the top and bottom of the sheet. Each sheet of paper shall be of the same size and on A4 paper or such other size as the Registrar may permit.The pages of documents, other than drawings, shall be numbered consecutively, preferably at the top of the page. Page margins shall be at least 2cm. Except for drawings, pages must be typed or printed, preferably with one and a half spacing or double spacing. An application shall be in English.
  3. Convention PriorityIf a convention priority is requested in respect of an application, it may be claimed either at the time of filing the application or at some later time before the grant of patent, but not thereafter.
  4. Duration and AnnuityThe registration of a patent expires 20 years after the filing date of the application. In order to maintain a patent, the owner of the patent shall pay in advance to the Registrar for each year starting one year after the filing date of the application of the grant of the patent, the prescribed annual fee.
  5. Late Payment of FeesWhere the period prescribed for the payment of the annual fee expires and payment of the fee has not been made, a period of grace not exceeding six months is granted within which the annual and the late payment fees should be paid.
